The Downtown Raleigh Alliance, in cooperation with the Greater Raleigh Convention and Visitors Bureau, the Raleigh Convention Center, the Greater Raleigh Chamber of Commerce, the City of Raleigh Economic Development Office, the Research Triangle Regional Partnership, and Wake County Economic Development, is calling all amateur and professional photographers!

Enter a photograph of Raleigh’s skyline for a chance to win a $750 cash prize! The first place photographs will be displayed in the lobby of Raleigh's newest addition to the skyline, Charter Square!

What: Downtown Raleigh Skyline Photo Contest

SUBMISSION GUIDELINES:

Participants must submit an electronic version of their photograph(s) along with the official contest entry form to Stacey Simeone at staceysimeone@downtownraleigh.org no later than September 30, 2014 at 5 pm. Entrants may submit up to four photos, two in each category.

The image must be 300 DPI and at least 12x18 inches. Entries with a resolution less than 300 DPI will not be considered. Photograph must be taken in 2014.

My Sky Photo Contest (“Contest”) OFFICIAL RULES

NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

SPONSOR: The sponsor of this Contest is the Downtown Raleigh Alliance, 120 South Wilmington Street #103, Raleigh, North Carolina 27601, telephone (919) 832-1231 (“Sponsor”).

WHO MAY ENTER: THIS CONTEST IS OPEN TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER. YOU MAY NOT PARTICIPATE IF YOU ARE NOT A LEGAL U.S. RESIDENT AND PHYSICALLY LOCATED WITHIN THE U.S. AT THE TIME OF ENTRY.

The following persons are not eligible to enter the Contest: (a) officers, employees or agents of Sponsor; (b) officers, employees or agents of any organizations directly involved with the Contest, including any co-sponsor of the Contest; and (c) immediate family members and persons living in the same household as the persons identified in (a) and (b) above. Void where prohibited or restricted by law.

HOW TO ENTER: Between September 1, 2014 and September 30, 2014, and no later than 5:00 P.M. Eastern on September 30, 2014 (“Contest Period”), submit (1) the My Sky Photo Contest Entry Form, and (2) up to four (4) of your best photographs of the downtown Raleigh skyline, taken in 2014 (“Photographs”), to Sponsor, via e-mail, c/o Stacey Simeone, at staceysimeone@downtownraleigh.org. Contest entrants (“Entrants”) may submit up to two (2) Photographs in each of the following categories: (1) Day Shot, and (2) Night Shot, for up to a total of four (4) Photographs. Each Photograph must have a resolution of at least three hundred (300) dots per inch (dpi) and must be at least twelve by eighteen (12x18) inches, and Photographs not meeting these criteria are automatically disqualified. For purposes of the Contest, “receipt” of an entry occurs when Sponsor’s servers receive the e-mail at the e-mail address indicated above. All winners must meet the eligibility requirements set forth in these Official Rules in order to qualify for the prizes. Sponsor is not responsible for lost, late, misdirected, incomplete or illegible entries. Sponsor is not responsible for any technical failures during the Contest Period, including any technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received on account of traffic congestion on the internet, or any combination thereof including any injury or damage to an Entrant’s or any other person’s computer related to or resulting from downloading any material related to the Contest, all of which may affect a person’s ability to participate in the Contest.

CERTIFICATION OF OWNERSHIP. By entering the Contest and tendering the Photographs, you hereby certify (a) that you are the sole author of all elements of each Photograph; (b) that the Photographs do not violate or infringe upon the rights of any third party, including but not limited to copyrights, trademarks, trade dress, logos, designs, copyrights, paintings, sculptural works or any other works of authorship by a third party; (c) that the Photographs do not contain recognizable images of any person or otherwise violate the right of publicity or privacy of any person. Entrants agree to indemnify and hold Sponsor, its successors, and assigns from and against any and all liability, loss, damage, or judgments that any of the foregoing may suffer by reason of any failure of Photographs to comply with the terms of these rules, including but not limited to the infringement of any third party’s intellectual property rights or the failure to obtain any required license, waiver, consent, or permission.  

SELECTION OF WINNERS: The winning Photographs will be selected on or before October 24, 2014, by representatives of Sponsor, The Greater Raleigh Chamber of Commerce, The City of Raleigh Economic Development Office, The Raleigh Convention Center, The Research Triangle Regional Partnership, Wake Economic Development, and The Greater Raleigh Convention & Visitors Bureau, based on the overall aesthetic appeal, creativity, and positive portrayal of Raleigh of the Photographs, in their sole and absolute discretion.

PRIZES: The first place winner in each category will receive a $750 cash prize. The runner up in each category will receive a $500 cash prize. Only the prizes specified above will be awarded. Prizes are non-transferable. All federal, state and local income taxes and fees connected to the prize are the sole responsibility of the winners. All federal, state and local laws and regulations apply. Sponsor shall only be responsible for awarding the number of prizes as stated in these Official Rules.

CLAIMING PRIZE: All properly claimed prizes will be awarded. As a condition of winning the prizes, where permitted by law, the winners must complete, sign and return an affidavit of eligibility and liability and publicity release, an affidavit regarding compliance with these Official Rules and stating that the Photographs submitted do not infringe on any third party rights or violate any applicable laws, and any other applicable forms required by any taxing authority, all within ten (10) days of receipt of written prize notification, or prizes will be forfeited and alternate winners selected. Further, by accepting the prizes, the winners consent to Sponsor’s use of their name, Photographs and likeness, address, voice, biographical information, and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and Internet), for all legitimate business purposes including advertising and promotional activities without additional compensation, unless prohibited by law. If any correspondence of the Contest judge or any prize is returned as undeliverable, the corresponding prize will be forfeited and will be awarded to an alternate winner. Should a winner make any false statement in any document referenced above, the winner will be required to promptly return to Sponsor his or her prize. In the event there is a dispute of the Entrant’s identity, the prize will be awarded to the established e-mail account associated with the entry. Any potential winner may be requested to provide Sponsor with proof that such winner is the authorized account holder of the e-mail address associated with the winning entry.

PHOTOGRAPH LICENSE. By entering the Contest and tendering the Photographs in exchange for valuable consideration – the sufficiency of which is hereby acknowledged – in the form of the opportunity to compete for cash prizes, each Entrant (a) grants Sponsor and its authorized agents and representatives a license to copy, display, print, and otherwise use each Photograph to the extent reasonably necessary to review the Photographs and select the winners in accordance with these Contest rules; and (b) agrees that in the event one or more of your Photographs is selected as a first place or runner up winner, you hereby grant Sponsor an irrevocable unlimited license to reproduce, modify, display, distribute, and exhibit – and to permit others to perform all of the foregoing acts -- the winning and second place Photographs, in whole or in part, in any manner or media (whether now existing or created in the future), in perpetuity, throughout the universe. “Media” for purposes of these Contest rules shall include by way of illustration only: newspapers, magazines, books (both paper and electronic), Internet, radio (both terrestrial and Internet-based), television, videotapes, CDs, DVDs, social media, audiovisual presentations, and electronic databases.

Sponsor is under no obligation to reproduce, display, distribute, perform and/or exhibit the Photographs in any manner. Entrant hereby waives (i) the right to inspect or approve of any reproduction, display, distribution, modification and/or exhibition of the Photographs, (ii) any rights to injunctive relief Entrant may have in connection with this license, and (iii) the right to revoke this license.  
PRIVACY: Sponsor will be collecting personal data about Entrants. By participating in the Contest, you hereby agree to Sponsor’s collection and usage of your personal information.

LIMITATION OF LIABILITY: By participating in the Contest, Entrants agree to release, hold harmless, and agree not to institute any claim against Sponsor and all co-sponsors of the Contest and each of their respective parent companies, affiliates, subsidiaries, and their respective officers, directors, employees, agents, and representatives (collectively, “Released Parties”) from any and all liability whatsoever for any injuries, losses or damages of any kind arising from or in connection with, either directly or indirectly, (1) the awarding, acceptance, receipt, possession, use or misuse of any prize awarded herein; and (2) participation in the Contest or any prize related activities. Upon delivery of the prize to the winner, Sponsor will be deemed to have awarded the prize to the winner with winner assuming full responsibility for the prize. Under no circumstances will Entrants be permitted to obtain awards for, and Entrants hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, and Entrants further waive all rights to have damages multiplied or increased.

MISCELLANEOUS CONDITIONS: If, for any reason, the Contest is not capable of running as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. Persons found tampering with or abusing any aspect of the Contest, or whom Sponsor believes to be causing malfunction, error, disruption or damage will be disqualified. Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors.

CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrants and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of North Carolina, without regard to North Carolina conflict of law principles.
